AI & Data Use

Capital Source may index, tokenize, store, analyze, and use any information, content, documents, or data that you upload, submit, transmit, or otherwise make available through this website (“User Submissions”) for purposes including, but not limited to, improving services, training, evaluating, or testing artificial intelligence (AI) or machine learning (ML) models, or otherwise enhancing our products, services, or operations.

Ownership & License

You retain all ownership rights in your User Submissions. By providing User Submissions, you grant Capital Source a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and transferable sublicensable license to use, reproduce, modify, adapt, publish, distribute, and otherwise process such User Submissions for the foregoing purposes. You represent and warrant that you have all necessary rights, licenses, consents, and permissions to grant this license and to allow Capital Source to use your User Submissions as described.

Sensitive Data

You agree not to upload or submit any protected health information (PHI), government identification numbers, payment card information, financial account credentials, or other sensitive personal data unless you have obtained all legally required rights and consents to do so. Capital Source disclaims all liability for the unauthorized submission of such information.

Confidentiality Disclaimer

You acknowledge that any confidential or proprietary information you submit may be accessed or processed by Capital Source’s personnel, contractors, or third-party service providers in connection with AI-related activities. While Capital Source uses reasonable safeguards to protect your User Submissions, it cannot guarantee confidentiality during or after AI processing, and you submit such information at your own risk.

Data Protection & Privacy

Capital Source will process any personal information contained in User Submissions in accordance with applicable data protection and privacy laws, including the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and other relevant U.S. federal or state laws. Users may exercise their data subject rights (including rights to access, correct, delete, or restrict processing of personal data) by contacting Capital Source at info@capital$ourcegroup.com. Capital Source processes User Submissions on the lawful bases of consent, legitimate interest, and/or contractual necessity, as applicable.

Third-Party Processors & Cross-Border Transfers

Capital Source may engage third-party vendors, contractors, cloud infrastructure providers, or AI service providers to perform some or all AI-related processing. While Capital Source seeks to engage reputable service providers and to require them contractually to implement appropriate technical, organizational, and confidentiality safeguards, you acknowledge and agree that this is an emerging and rapidly evolving area of information technology. As such, Capital Source cannot and does not guarantee that all such third parties will fully comply with this Agreement or with all applicable privacy and security standards at all times. You understand and consent that your User Submissions may be transferred to, stored in, or processed in countries other than your country of residence, subject to applicable law, and you assume any associated risks to the extent permitted by law.

Retention & Deletion

Capital Source will retain User Submissions and derived data (including tokenized or indexed representations) only as long as necessary to fulfill the purposes described herein or as required by law. Once data has been aggregated, anonymized, or incorporated into trained models, it may not be technically feasible to remove or reverse it. However, Capital Source will delete raw User Submissions upon verified user request where legally required.

Opt-Out

You may request that Capital Source discontinue using your User Submissions for AI training or indexing by contacting info@capitalsourcegroup.com. Capital Source will comply with such requests in accordance with applicable law, but you acknowledge that content already used or integrated into existing models or indices may not be reversible.

Disclaimer of Accuracy

Any outputs, results, or content generated by AI or machine learning models based on User Submissions or other data are provided “as is” without warranties of any kind. Capital Source does not warrant that such outputs will be accurate, complete, reliable, or fit for any particular purpose. Your use or reliance on any AI-based outputs is at your own risk.

Security

Capital Source implements reasonable administrative, technical, and physical safeguards to protect User Submissions during collection, processing, and storage. However, no method of transmission or storage is completely secure, and Capital Source cannot guarantee or warrant absolute security.

Indemnification & Limitation of Liability

You agree to indemnify, defend, and hold harmless Capital Source, its affiliates, officers, directors, employees, agents, and contractors from and against any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from or relating to (i) your User Submissions, including any claim that such User Submissions infringe or misappropriate the intellectual property, privacy, or other rights of any third party, or (ii) your use or reliance on AI-generated outputs. To the fullest extent permitted by law, Capital Source disclaims all liability for any damages arising out of or related to AI-based processing or outputs.

Export Compliance

You agree not to provide any User Submissions or use the website or related services in violation of applicable export control, economic sanctions, or similar laws.

SMS/Text Messaging Program

By providing your mobile telephone number to Capital Source Group, LLC (“Capital Source”), you consent to receive SMS/text messages from us related to your inquiries, lead submissions, funding applications, account updates, underwriting communications, and promotional or marketing messages about our products and services.

Opt-In Consent
By submitting any web form, lead form, application, or by otherwise providing your mobile number to us, you expressly consent to receive text messages from Capital Source at the number you provide. Your consent is not a condition of receiving any products or services.

Message Frequency
Message frequency varies and may depend on your interactions with us, your account status, or your funding application activity.

Opt-Out Instructions
You may opt out of receiving SMS/text messages at any time by replying “STOP” to any message we send. After texting STOP, you will receive a confirmation message and will no longer receive SMS messages from us unless you subsequently provide renewed consent.

Carrier & Cost Disclosure

Information Collected
We may collect your phone number, message content, delivery information, opt-in status, opt-out requests, and related metadata. All such data is handled in accordance with our Privacy Policy.

Severability

If any provision of these Terms of Use is deemed unlawful, void, or unenforceable, that provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.

Force Majeure

Capital Source shall not be liable for any failure or delay in performance due in whole or in part to any cause beyond the reasonable control of such party or its contractors, agents or suppliers, including but not limited to utility or transmission failures, power failure, strikes or other labor disturbances, acts of God, acts of war or terror, floods, sabotage, fire, natural or other disasters.
